Until very recently, there was no regulation on how to secure the load on a lorry. The only reference we found was in the General Traffic Regulations (RD 1428/2003) Art14. and only mentioned observing «the load must be well fastened.

Since June 2017, with RD 563/2017, being a European transposition, an attempt has been made to accommodate these deficiencies. It entered into force on 20 May 2018 and covers the following points:

  • It regulates the technical inspections that must be carried out on commercial vehicles in Spanish territory.
  • Annex III sets out a series of technical standards, which must be applied in the fixing of truck loads. It includes and regulates, among others, the minimum number of moorings to be placed, the mooring capacity, and who is responsible in the event of an accident under certain circumstances.

Controversy over new stowage regulations that attribute responsibility for infringements to the driver

Fetransa wanted to register its concern with the extent to which the new rule contradicts transport legislation, in which it assigns responsibility for the loading of goods into the vehicle to the loader, and not to the driver, as the new legislation attributes.

Among other things, it has recommended including previous training in this subject both in the initial CAP and in continuous training. Thus, in part, it would make it possible to raise the driver’s awareness and enable him to some extent to conform to the standard without the risk of erroneous interpretations.
